California Assembly Bill 12 (AB 12) has brought about significant changes to the rental housing landscape in the state, particularly regarding security deposits. One of the key provisions of AB 12 is the limitation of security deposits to one month's rent, effective July 1, 2024. For Landlords: The new limitation on the holding of security deposits represents a bit of a shift in financial risk and planning. Landlords routinely may have sought higher security deposits as a form of protection against potential damages or unpaid rent. With the cap set at one month's rent, landlords may perceive increased vulnerability to risks associated with owning investment property. However, this limitation also aims to accelerate the leasing process and make housing more affordable for tenants. By reducing move-in costs, landlords may attract a larger pool of prospective tenants, thereby reducing vacancy periods and maximizing rental income in the long run. Furthermore, this new bill impacts pet owners who may be tenants or landlords alike. Pet deposits are included under the same limitation, so landlords may opt to collect an “additional deposit” not to exceed one month’s rent. For Tenants: The limitation of security deposits to one month's rent is a positive development, especially in a housing market where affordability is of significant concern. By capping security deposits, AB 12 reduces the upfront financial burden on tenants, making it easier for individuals and families to secure rental housing. Tenants can now anticipate and budget for a consistent security deposit amount, eliminating financial uncertainty and potential disputes during the leasing process. Bottom Line: Enacting this new limitation on security deposits to one month's rent marks a significant milestone in California’s rental housing regulation. While landlords may initially face adjustments in risk management and financial planning, the standardized security deposit amount holds benefits for both landlords and tenants. Overall, AB 12 aims to promote a more balanced approach to tenant protection and landlord interests, fostering a more equitable and sustainable rental housing market in California.
